根據《國務院關于職工工作時間的規定》，每周職工法定工作時間平均為44小時。每月實際工作天數為：（365－7－52－26）÷12＝23.33（天）。為便于計算，可統一規定每月法定工作天數為23.5天，或按每月實際工作的日歷天數，小時工資亦可按此進行折算。

二、規范提法。今后，各地在文件和上報材料中，不應再使用“托管”、“托管中心”、“托管協議”、“托管率”等不規范的提法，而應使用規范的提法：如進入再就業服務中心、簽訂基本生活保障和再就業協議（或簡稱“進中心協議”）、進入再就業服務中心的下崗職工比例等。“協議保留勞動關系”應規范為“協議保留社會保險關系”。行業或政府部門辦的再就業服務中心應規范為再就業服務指導中心。
